Notice is hereby given that the City of Biloxi, Mississippi, will receive sealed proposals at City Hall, Second floor, Mayor's Office, until 10:00 a.m. on the 2nd day of July, 2025, for the following:
SAENGER CARPETING
CITY OF BILOXI, MISSISSIPPI
Proposals are sought for delivery, carpeting and installation of approximately 1,000 square yards of commercial grade carpet tiles in the Saenger Theatre (see specifications for further details). Carpet must be of a suitable design, color and pattern the historic Theatre (sample designs include in specifications. Specifications are available on-line at www.biloxiplans.com and in the Purchasing Office, City Hall, 140 Lameuse Street, Biloxi, Mississippi (228) 435-6252.
All bidders are responsible for verifying conditions of subfloor and yardage required. Bid will be presented as a lump sum cost, which includes all subfloor preparation, materials and labor.
The maximum time allowable for completion of said project is sixty (60) calendar days following the City's written order to commence (Notice to Proceed).
The successful bidder will be required to furnish a 100% Payment and Performance Bond if the bid equals or exceeds $25,000. If the bid is less than $25,000, the City of Biloxi may elect to make a lump sum payment at the completion of the job, in which case a payment and performance bond shall not be required.
Proposals must be accompanied by a Proposal Guaranty consisting of a Bid Bond, Cashier's Check or Certified Check in the amount of 5% of the ammmt of the bid. Such security to be forfeited as liquidated damages, not penalty, by any bidder who fails to carry out the terms of the accepted Bid and/or execute the Contract and Post Performance and Payment Bond as required within the time specified.
Proposals will be rated on the following system to determine best bid received: Proposed Fees to the City (40%); Delivery/Install Date (40%); suitability of carpet design (20%).
The City expressly reserves the right to accept or reject any or all proposals or any part of any or all proposals based on a highest and best proposals determination. The City reserves the right to waive informalities.
PROPOSALS SHALL BE DELIVERED TO THE MAYOR'S OFFICE, SECOND FLOOR, CITY HALL BUILDING, 140 LAMEUSE STREET, BILOXI, MISSISSIPPI 39530 OR ELECTRONICALLY SUBMITTED AT WWW.BILOXIPLANS.COM.
Proposals sent through U.S. Mail are done so at the risk of the respondent and should be addressed to the City of Biloxi, City Hall, P.O. Box 429, Biloxi, MS 39533. The City is not responsible for proposals that arrive in the mail after the designated opening time. Bids may be delivered in person to City Hall, Second Floor, 140 Lameuse Street, Biloxi, MS.
All responses shall be plainly marked "SAENGER CARPETING" on the sealed envelope. Sealed proposals not so marked are submitted at the risk of the respondent and the City assumes no responsibility for the premature opening of same by any City employee.
If City Hall is closed for any reason, including but not limited to: acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, earthquakes, floods, or other natural disasters (the "Force Majeure Events"), which closure prevents the opening of proposals at the advertised date and time, all proposals received shall be publicly opened and read aloud on the next business day that the agency shall be open and at the previously advertised time. The new date and time of the proposals opening, as determined in accordance with this paragraph, shall not be advertised, and all respondents, upon submission of a proposal, shall be deemed to have knowledge of and shall have agreed to the provisions of this paragraph. Proposals shall be received by the City until the new date and time of the proposal opening as set forth herein. The City shall not be held responsible for the receipt of any proposals for which the delivery was attempted and failed due to the closure of City Hall as a result of a Force Majeure Event. Each respondent shall be required to ensure the delivery and receipt of its proposal by the City prior to the new date and time of the proposal opening.

Proposals must be received before 10:00 a.m. July 16, 2025. The selection committee will review each proposal and select qualified submitters to begin negotiations. The award(s) will be announced within thirty (30) of the bid opening.
